Habe nach einer erneuten Anfrage bei der Immigration Heute folgende Antwort bekommen:

Dear Heinz,
We would like to inform you that under Memorandum issued on July 1, 2008, Balikbayan privilege shall extend to the foreigner members of the families of Filipinos and former Filipinos, when traveling together regardless of the frequency of their travel.

Bis zu diesem Datum war es nicht mehr möglich ein BB zu bekommen, wenn die Frau noch Staatsangehörige der Philippinen (Doppelstaatsbürger ausgenommen) war.
Dies wurde mir auch in einem E-Mail von der Immigration bestätigt.
Leider wurde dieses Memorandum nicht in die offizielle Seite der Immigration eingestellt.
Dies führte natürlich zu kontroversen Diskussionen. Dieses Memorandum ist anscheinend nirgens zu finden.
Ich erinnere an die Aussage von Mendoza im Jahre 2007:
THE BALIKBAYAN PRIVILEGE (R.A.6768 as amended)
By legal definition, a Balikbayan is:
1. A Filipino citizen who has been continuously out of the Philippines for a period of at least 1 year;
2. A Filipino overseas worker; or
3. A former Filipino citizen and his or her family, who had been naturalized in a foreign country and comes or returns to the Philippines.
In the 1st and 2nd classification, the privilege is for the Filipino citizen only and not extendible to the foreigner members of his family. (Atty. Edgardo L. Mendoza, Chief of Immigration Regulation Division (IRD) of the Bureau of Immigration).
